Terms of Service for Commissions
01 - Copyright & UsageI, Venus (the artist):
Have the right to cancel and refund the order at any time for any reason.
I retain all copyrights over the commissioned artwork.
I won't claim the intellectual property (IP) of the commissioned artwork (your characters are still yours, etc.)
I won't profit further from the commissioned artwork unless you (the customer) break any of the terms.
I reserve the right to post the commissioned artwork online, in my portfolio as well as in publications such as art books UNLESS the client asks for confidentiality.
You (the customer/commissioner):
You can upload the commissioned artwork on any website and social channels WITH CREDIT.
You can NOT profit from the commissioned piece (reselling, redistributing, uploading to POD-services, making prints for selling, etc.)
You can NOT alter the commissioned artwork without my (the artist's) consent.
You CAN resell the artwork if it is a part of an Adoptable. Please discuss this with me (the artist) prior to paying for the artwork.
You retain the rights to the intellectual property (IP).
You can NOT use the commissioned artwork for commercial purposes, UNLESS discussed prior.
The following is considered copyright infringement:
Reproducing/using the copyrighted artwork commercially - means making money off it in any way not excluded from these terms.
Claiming the artwork as your own
Altering the artwork without my consent
In some cases, the commercial rights to the image may be purchased.
02 - Payment
The currencies accepted are USD and BRL and can be paid through PayPal, PicPay or bank transfer.
Commissions are paid split 50% upfront and 50% after sketch approval.Don't send me any payment before I have agreed to give you a slot and requested you to send me the payment.03 - Process & Delivery
The time it takes to finish your commission varies 1 week - 3 months depending on factors such as health, the complexity of the commissioned piece, other work, and con seasons.Once the piece is finished you will receive the full-resolution image along with a web-friendly size. Note that there is no physical product. Depending on where you live, we can arrange to print your artwork with applicable fees. Feel free to discuss this :].Additional notes:> I keep the artwork saved for up to 6 months so please do save it accordingly in a safe location.> I won't change anything nor give a refund after a commission is completed.> The artist retains NO responsibility or liability for what the client or third parties do with the artwork once the artwork is completed.> All work may be done in full confidentiality if the client asks for it with no additional fees.> I work all week between school, so please be patient.04 - RevisionsYou get 2 to 3 rounds of changes each stage of commission [sketch, line and color] where you can change whatever deems necessary at the current stage. For example in the sketch process you may ask to change te pose or certain body aspects but can't do that at line or color process because of previous approved work.A fee will be added if you want something changed on the final drawing - unless a misunderstanding from my side has been made.If you wish for me to change something in the drawing you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make and is usually based on an hourly wage.If your reference is unclear to start with changes will come at an extra charge.05 - Cancellation & Refund policyIf for any reason I am unable to start your commission you will receive a full refund.If you cancel your order before I started it, you can get a full refund.The buyer is not allowed a refund once I started working on the commission.If the buyer wishes to cancel the commission after the work has started, the buyer can be issued a refund but agrees to pay the kill fee.The kill fee for canceling the commission after work has begun is 50% of the commission's price. The client then receives the work as is.Paypal specific:
If you are getting a refund, do not request a Paypal chargeback. I will transfer the money back to you myself.If you request a Paypal chargeback at any point when you were not allowed to ask for a refund you will lose all beforementioned rights to the commissioned piece and I will have the full right to profit further from it in any way. I will decline the chargeback and supply Paypal with our conversations in which we talk about the commission as evidence that I have completed work for you. Furthermore, you will be blacklisted for commissioning me again.All articles of this Terms of Service Agreement are applicable unless specifically outlined within the final written agreement between Client and Artist.By contacting me for work you are hereby agreeing to the terms expressed above.

Você (o cliente/commissioner):
Pode repostar a arte commissionada em qualquer website e redes sociais COM CRÉDITO.
Você NÃO pode ganhar por cima da peça commissionada (revenda, redistribuição, venda de impressões, etc.)
Você NÃO pode alterar a arte commissionada sem o consentimento do artista (eu).
Você TALVEZ possa revender a arte caso seja parte de um adoptable. Por favor discuta isso com o artista (eu) antes do pagamento..
Você retem direitos a propriedade intelectual.
Você NÃO pode usar a arte commissionada para fins comerciais.
As ações citadas a seguir contam como violação de direitos autorais:
Reprodução/uso da arte protegida de forma comercial - ou seja, ganhando pro cima dela.
Dizer que a arte é sua.
Alterar a arte sem o meu consentimento
Em alguns casos, é possível comprar os direitos comerciais para uma imagem..
02 - Pagamento
É aceito dólar e real brasileiro pelas plataformas PayPal e PicPay ou transferencia bancária.
Commissions são pagas 50% na hora e 50% após aprovação do sketch.
Não envie dinheiro antes que eu aceite o pedido e dê inicio ao pedido de pagamento.03 - Processo & Entrega
Demoro de 1 a 3 meses, com várias variaveis como saúde, complexidade da commission, trabalho, escola e outras commissions.Assim que o desenho for terminado, você recebera a imagem em resolução completa, junto de uma imagem em tamanho otimizado para internet. Tenha em mente que não há produto físico. Dependendo de onde você mora, talvez seja possível providenciar uma impressão e envio com algumas taxas adicionais. Fique a vontade para discutir sobre :].Notas adicionais:> Fico com o arquivo até 6 meses, por favor salve o arquivo em um local seguro.> Não vou mudar NADA nem te dar reembolso depois que a commission terminar.> O artista NÃO se responsabiliza pelo que o cliente ou terceiros fazem com a obra de arte uma vez que a obra de arte é concluída, ou seja, danos causados a obra não são de responsabilidade do artista.> Todo o trabalho pode ser feito em sigilo completo, caso o cliente prefira sem taxas adicionais.> Trabalho a semana toda entre escola, por favor seja paciente.04 - RevisõesVocê pode mudar de 2 a 3 coisas a cada estágio da commission, rascunho, line e cor, onde você pode mudar o que for possível no estágio atual. Por exemplo você pode mudar uma pose na parte do sketch mas não na parte da line pois o processo já havia sido aprovado anteriormente.Uma taxa será cobrada a cada mudança extra no desenho final - a não ser que eu tenha entendido algo errado.Se você quiser mudar algo que já foi aprovado, eu vou cobrar uma taxa. A quantia extra pode variar com as mudanças que você quer, visto que meus preços são baseados na minha carga horária.Se suas referencias forem vagas para iniciar as mudanças em uma commission os preços virão com uma cobrança extra.05 - Cancelamento & ReembolsoSe por algum motivo eu não poder começar sua commission, você receberá um reembolso total.Se você cancelar ANTES da commission ser iniciada você tem direito a um reemboslo total.O comprador não pode pedir reembolso assim que eu começar a trabalhar na commission.Se o comprador desejar cancelar a commission logo depois de ser começada, ele tem direito a um reembolso mas concorda em pagar a taxa de cancelamento.A taxa de cancelamento da commission já iniciada é de 50% do preço. O cliente recebe o produto do jeito que está.Pagamento por Paypal:
Se você pedir um reembolso, não peça chargeback/estorno do próprio PayPal. Eu vou te transferir o dinheiro pra você.Se você solicitar um estorno do Paypal a qualquer momento em que não tinha permissão para solicitar um reembolso, perderá todos os direitos mencionados anteriormente sobre a peça encomendada e eu terei todo o direito de lucrar mais com ela de qualquer maneira. Recusarei o estorno e fornecerei ao Paypal nossas conversas nas quais falamos sobre a commission como prova de que concluí o trabalho para você. Além disso, você entrará em uma blacklist e não poderá commissionar comigo de novo.Todos os artigos deste Contrato de Termos de Serviço são aplicáveis, a menos que especificamente descritos no contrato final por escrito entre o Cliente e o Artista.Ao entrar em contato comigo para o trabalho, você concorda com os termos expressos acima.
